2021-01-03Many office workers this year began performing their duties remotely. As a result, the employer’s communication with employees can be somewhat difficult.
It can also seem troublesome to deliver an employee’s termination without direct contact.
How can this be done?
Remote working vs. termination of employment
The formal requirement for an employer to terminate or terminate an employment contract is to deliver the document to the employee in writing. By written form we mean a traditional hand-signed letter on paper or an electronic document signed with a qualified electronic signature. Such a form is important especially when, according to the regulations, the notice of termination must be accompanied by a detailed justification for the employee’s dismissal.
However, it is also permissible to inform the employee of the termination of the employment contract in other ways than just by providing him with a letter signed by the employer. The employer may terminate the employee:
- verbally,
- by telephone,
- by letter signed with a non-qualified electronic signature,
- by faxing a letter drafted by the employer,
- by emailing a scan of the letter.
Such termination of employment, although not in compliance with the Labor Code, is effective. However, it should be borne in mind that it entitles the employee to take legal action with claims provided by law.
